By using our website or opting in to receive communications from Bear Solar, you agree to these Terms.

Bear Solar provides solar, battery, energy consultation, proposal, project coordination, and related services. Information provided through our website, forms, messages, estimates, or proposals is for informational and customer communication purposes and may be subject to site review, utility requirements, equipment availability, financing approval where applicable, permitting, and final project validation.

2. Use of Our Website and Services

You agree to use our website and services only for lawful purposes. You agree not to submit false information, interfere with website operation, attempt unauthorized access, or misuse our forms, systems, or communications.

3. Solar Estimates and Proposals

Any solar savings estimate, production estimate, battery estimate, proposal, or related information provided by Bear Solar is preliminary unless expressly stated otherwise in a signed agreement. Actual system size, cost, savings, incentives, production, utility rates, and project scope may vary based on site conditions, energy usage, roof condition, shading, utility rules, permitting, equipment selection, financing terms, and other factors.

4. SMS/Text Messaging Terms

Bear Solar Inc. operates two separate text message categories. Consent to each category is optional, is collected separately, and is never inferred from the other. You may consent to either category, both categories, or neither, and consent is never required to request or receive a quote.

Customer Care and Account Notification Messages

By checking the customer care box and providing your mobile number, you agree to receive recurring customer care and informational text messages from Bear Solar Inc. at the number provided about your quote, appointments, proposal, installation, project status, and support, including messages sent using automated technology.

Message frequency in this category varies with your inquiry or project.

Marketing Messages

By checking the separate marketing box and providing your mobile number, you agree to receive recurring marketing and promotional text messages from Bear Solar Inc. at the number provided about solar and battery products, offers, and availability, including messages sent using automated technology.

You will receive up to 4 marketing messages per month in this category.

Bear Solar sends marketing texts only to numbers that gave marketing consent, and customer care texts only to numbers that gave customer care consent. Consenting to one category does not enroll you in the other.

5. How Bear Solar Collects SMS Consent

Bear Solar Inc. currently collects SMS consent in one place: the public quote form on our website, shown at bearsolar.com/#start and on the dedicated quote page at bearsolar.com/quote. Both display the same form and the same consent language.

That form presents two separate checkboxes. Both are optional, both are unchecked by default, and neither is required to submit the form. Checking one does not check the other. A valid mobile number is required only if you check at least one of them.

The exact disclosure shown beside each checkbox is:

Each submission is recorded with the categories selected, the date and time the consent was received, the page the form was submitted from, and the version of the disclosure shown above.

SMS consent is not collected through any other channel. Bear Solar does not purchase, rent, or accept SMS consent or mobile numbers from third parties or lead sellers.

6. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. SMS delivery is subject to carrier availability, network conditions, and device compatibility.

7. Privacy

Your use of our website and services is also governed by our Privacy Policy, available at: bearsolar.com/privacy, which describes how each SMS consent category is collected, recorded, and used.

Bear Solar does not sell, rent, or share mobile phone numbers, SMS opt-in data, or SMS consent information with third parties, affiliates, or lead generators for their marketing or promotional purposes.

8. Email and Other Communications

If you provide your email address or other contact information, Bear Solar may contact you about your inquiry, appointment, proposal, project, support request, or related services. You may unsubscribe from marketing emails using the unsubscribe link included in those emails, if applicable.

9. No Guarantee of Results

Bear Solar does not guarantee specific energy savings, utility bill reduction, tax benefits, incentives, production output, project approval, interconnection approval, or financing approval unless expressly stated in a signed agreement. Any estimates are subject to review and may change.

10. Intellectual Property

All content on the Bear Solar website, including text, graphics, logos, designs, images, documents, and other materials, is owned by or licensed to Bear Solar and may not be copied, reproduced, distributed, or used without permission.

11. Limitation of Liability

To the fullest extent permitted by law, Bear Solar is not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of our website, communications, estimates, or services.

12. Changes to These Terms

Bear Solar may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted means you accept the updated Terms.
